Blake Walsh, the boyfriend of Kaylin Gillis, is suing both Kevin and Jinx Monahan for emotional distress, according to documents filed in New York State Supreme Court in Washington County.

Kevin Monahan was convicted in January of second-degree murder in the death of Gillis. She was a passenger in a vehicle driven by Walsh that entered Monahan’s driveway by mistake, assuming it was the home the couple and several friends were looking for on that April evening last year.

Law enforcement said Monahan fired two shots from a 20-guage shotgun at the vehicle as it was turning around to leave. One of the rounds struck the 20-year Gillis in the neck, causing her death.

Walsh’s attorney, Peter Scagnelli, wrote in his filing that Monahan was easily prone to “becoming emotionally distraught and agitated in a variety of circumstances,” and that his wife, Jinx, was “negligent, careless and reckless” by allowing firearms to be unsecured and available to her husband.

The suit seeks an unspecified amount of damages.

Second Lawsuit

The Monahans already face a wrongful death lawsuit filed by Gillis’ father Andrew.

Monahan’s attorney has agreed not to sell or transfer any of the Monahans’ assets while the civil case is proceeding. In the suit, Andrew Gillis expressed his concern Monahan would sell down the value of his estate on his pending appeal.

Monahan was sentenced to 25 years to life in prison earlier this month on the murder charge. A conviction on a single count of endangerment will run concurrent with the murder sentence. Monahan was also found guilty of tampering with evidence. That sentence will start when the murder count is satisfied.

This past week, Monahan was transferred to the NYS Correctional Facility in Elmira to serve his time. He has filed an appeal of his conviction.
